Introduction

1.1

These Terms and Conditions (“T&Cs”) govern your membership and use of Activ8 Fitness (“the Club”), a women-only fitness facility located in Bedford.

1.2

By joining Activ8 Fitness, you (“the Member”) agree to comply with these T&Cs, the Club Rules, and any policies displayed in the Club or communicated to you from time to time.

1.3

Activ8 Fitness reserves the right to update these T&Cs. Members will be notified of any significant changes.

Membership Agreement & Fees

2.1

Memberships are offered on the following plans:

Monthly Direct Debit: £32.95 per month (12-month minimum contract, then rolling monthly)
6-Month Direct Debit: £39.95 per month (6-month minimum contract, then rolling monthly)
Blue Light card holders and Students ages 16-18: £29.95
Annual One-Off Payment: £359.95 (paid upfront for 12 months)

2.2

All membership plans include unlimited access to gym facilities and scheduled classes at no extra cost.

2.3

After the minimum contract term, memberships automatically continue on a rolling monthly basis until cancelled by either party with the required notice (see Section 4).

2.4

Membership is personal to you and is non-transferable.

2.5

Members must be 18 years or older to join. Students between 16-18 can join only using the student membership option.

Payments

3.1

Payments must be made by Direct Debit on the agreed date each month, or in full upfront for an annual membership.

3.2

If a Direct Debit payment fails, Activ8 Fitness reserves the right to:

Charge a reasonable administration fee,
Suspend access until payment is received, and/or
Use debt collection services to recover outstanding amounts.

Cancellation, Suspension & Termination

4.1

Cooling-off Period: You may cancel your membership within 14 days of joining for a full refund, provided you have not used the facilities.

4.2

End of Term: After the initial minimum term (6 months or 12 months depending on plan), memberships continue on a monthly basis unless you provide 30 days’ written notice to cancel.

4.3

Memberships cannot normally be frozen. However, where a Member is unable to use the facilities due to a medical condition, illness, injury, pregnancy, or other exceptional circumstance, Activ8 Fitness may, at its sole discretion, offer a temporary suspension of membership.

Requests must be supported by satisfactory evidence where requested by the Club. The duration and terms of any suspension shall be determined by management.

4.4

Early termination during the minimum membership term will only be considered in exceptional circumstances.

Requests must be submitted in writing and supported by evidence satisfactory to Activ8 Fitness.

Examples of circumstances that may be considered include:

A long-term medical condition, illness, or injury that prevents the Member from using the facilities for a continuous period of at least three months.
Relocation of the Member’s permanent residence to more than 15 miles from the Club.

Activ8 Fitness reserves the right to:

Request additional evidence;
Offer a temporary suspension instead of cancellation;
Approve or decline the request at its reasonable discretion.

Approval of one request shall not create a precedent for future requests.

Where a request is approved, Activ8 Fitness may apply a reasonable administration fee or other charges permitted by law.

Medical evidence must clearly indicate that the Member is unable to safely participate in exercise or use gym facilities. General recommendations, precautionary advice, or statements based solely on the Member’s self-reported symptoms may not, by themselves, be sufficient evidence for early termination.

4.5

Activ8 Fitness reserves the right to terminate your membership immediately if you:

Breach these T&Cs or the Club Rules;
Engage in behaviour deemed inappropriate, unsafe, or in conflict with our women-only policy.

Facilities and Services

5.1

The Club is open 24 hours a day, 7 days a week. Staffed hours are typically 8am – 8pm but are subject to change.

5.2

Membership includes unlimited access to gym facilities and all scheduled classes. There are no additional charges for classes.

5.3

Personal Training (PT) sessions are not included in membership and must be purchased separately.

5.4

Activ8 Fitness reserves the right to change timetables, class availability, or facilities for operational reasons.

Club Rules

6.1

Women-only Policy: Activ8 Fitness is exclusively for women. Men are not permitted within the facility at any time. Any breach of this rule will result in immediate termination of membership.

6.2

Age Restriction: Members must be 18 years or older.

6.3

Guest Policy: Members may not bring guests into the Club without prior consent from management.

6.4

Behaviour: Members must behave respectfully towards staff and other members. Anti-social, aggressive, or intimidating behaviour will not be tolerated.

6.5

Privacy: To protect the comfort and safety of members, filming, photography, and live streaming are strictly prohibited inside the Club.

6.6

Dress Code: Appropriate fitness attire must be worn at all times.

6.7

Members must wipe down equipment after use and return weights/equipment to designated storage.

6.8

Smoking, vaping, alcohol, or drugs are strictly prohibited inside the Club.

Health & Safety

7.1

Members must complete a PAR-Q (Physical Activity Readiness Questionnaire) prior to using the facilities.

7.2

Members are responsible for ensuring they are physically fit to participate in exercise. If in doubt, consult your GP before joining.

7.3

Use of the facilities is at your own risk. Activ8 Fitness accepts no liability for personal injury or health issues sustained through misuse of equipment or failure to follow guidance.

7.4

Members must immediately report any injuries, accidents, or equipment faults to staff during staffed hours.

Liability

8.1

Activ8 Fitness does not accept responsibility for loss, theft, or damage to personal property brought into the Club.

8.2

Lockers are provided but are not security safes; use is at the member’s own risk.

8.3

Nothing in these T&Cs limits Activ8 Fitness’ liability for death or personal injury caused by negligence.

Data Protection & Privacy (GDPR)

9.1

Activ8 Fitness collects and processes personal data in accordance with UK GDPR.

9.2

Data may include contact details, health declarations, and payment information.

9.3

Member data will be used for:

Managing memberships, payments, and access;
Providing updates on classes, services, and Club news;
Health & safety compliance.

9.4

Member data will not be shared with third parties except where legally required or where essential to deliver our services (e.g. payment providers, ClubRight system).

9.5

By joining, you consent to the use of your data as outlined.

Transfer of Memberships

10.1

If Activ8 Fitness is sold or transferred to a new operator, all active memberships will automatically transfer to the new owner/operator on the same terms and conditions.

General

11.1

Membership terms are governed by the laws of England and Wales.

11.2

If any provision of these T&Cs is found to be invalid, the remainder shall remain enforceable.

11.3

Activ8 Fitness reserves the right to refuse membership at its discretion.
